PrettyFast Terms and Conditions for Service Providers
Introduction Welcome to PrettyFast mobile application, a beauty on-demand platform that connects service providers with clients seeking beauty services. By signing up and using our platform, you agree to be bound by these terms and conditions. Please read them carefully.
2. Definitions – **Platform:** Refers to PrettyFast, including its website and mobile application. – **Service Provider:** Any individual or entity providing beauty services, products or both products and serivices through the Platform. – **Client:** Any individual or entity seeking and receiving beauty services through the Platform. – **Transaction:** Any exchange of services for monetary compensation between a Service Provider and a Client facilitated through the Platform.
3. Registration and Eligibility – Service Providers must register on the Platform and provide accurate, complete, and up-to-date information. – Service Providers must be at least 18 years old and legally capable of entering into a binding contract. – Service Providers must possess all necessary licenses, certifications, and qualifications required to perform the services offered.
4. Services and Transactions – Service Providers shall offer beauty services as listed on the Platform and shall maintain a high standard of professionalism. – The Platform will facilitate transactions between Service Providers and Clients, including booking, payment processing, and service reviews.
5. Fees and Payment – The Platform will retain 10% of the total transaction amount for each service provided through the Platform. – Service Providers agree to pay a monthly subscription fee of R129 for being listed on and using the Platform. – Payments to Service Providers, minus the 10% transaction fee, will be processed and disbursed according to the Platform’s payment schedule, on the first (1) and fifteenth (15) of each month.
6. Cancellations and Refunds – Service Providers must adhere to the Platform’s cancellation policy, which allows Clients to cancel or reschedule appointments up to 24 hours in advance. – In the event of a late cancellation or no-show by a Client, Service Providers may be entitled to a partial payment as per the Platform’s policy. – Refunds to Clients will be handled by the Platform in accordance with the Platform’s refund policy.
7. Conduct and Responsibilities – Service Providers must conduct themselves professionally and courteously at all times. – Service Providers are responsible for their own tools, equipment, and supplies needed to perform services. – Service Providers must maintain the confidentiality and privacy of Client information in accordance with applicable laws and the Platform’s privacy policy.
8. Intellectual Property – Service Providers grant the Platform a non-exclusive, royalty-free license to use their name, images, likeness, and service descriptions for promotional and marketing purposes. – Service Providers retain all rights to their own intellectual property but agree not to infringe on the intellectual property rights of others.
9. Termination – The Platform reserves the right to terminate or suspend a Service Provider’s account at any time for any reason, including but not limited to violations of these terms and conditions. – Service Providers may terminate their account by providing written notice to the Platform. Any outstanding fees or obligations must be settled prior to termination.
10. Limitation of Liability – The Platform is not liable for any direct, indirect, incidental, special, or consequential damages arising from the use of the Platform or the services provided by Service Providers. – Service Providers agree to indemnify and hold harmless the Platform from any claims, liabilities, damages, or expenses arising from their use of the Platform or provision of services.
11. Dispute Resolution – Any disputes between Service Providers and Clients shall be resolved in accordance with the Platform’s dispute resolution policy. – Service Providers agree to attempt to resolve any disputes with the Platform amicably before pursuing any formal legal action.
12. Amendments – The Platform reserves the right to amend these terms and conditions at any time. Service Providers will be notified of any significant changes, and continued use of the Platform constitutes acceptance of the amended terms.
13. Governing Law – These terms and conditions shall be governed by and construed in accordance with the laws of South Africa.
